Ordinance 14: Possession & Consumption of Intoxicating Beverages
ORDINANCE # 14 POSSESSION AND CONSUMPTION OF INTOXICATING BEVERAGE
A person is guilty of public intoxication when he appears in a public place or upon the grounds of such public place manifestly under the influence of alcohol or narcotics or any other drug not administered or prescribed to be taken by a physician, to the degree that he may endanger himself or others, or property, or annoy persons in the vicinity.
No person who is under the age of twenty (20) years shall consume or have in his possession any alcoholic substance nor consume or have in his possession any alcoholic substance nor shall any person over the age of twenty (20) years provide a minor with such alcoholic substance.
Public intoxication, consumption or possession of alcohol by a person under twenty (20) years of age, and supplying a person who is under the age with an alcoholic substance by one who is over the age of twenty (20) are all separate violations and shall be punished as provided in Title II of the Delaware Code.
