Ordinance 16: Collection of Trash & Water Charges

The Townsend Town Council of Townsend, Delaware may collect any delinquent trash or water charges which have remained unpaid for a period of thirty days by instituting suit in the name of the Town of Townsend before any Justice of the Peace or in the County of Common Pleas of the State of Delaware, in and for New Castle County, or in the Superior Court of the State of Delaware, in and for New Castle County, for the recovery of the unpaid trash and water charges in an action of debt, and upon judgment obtained, may sue out writs of execution as in the case of other judgments recovered before the Justice of the Peace or in the Court of Common Pleas, or in the Superior Court as the case may be. In any action, the Town of Townsend shall be entitled to recover actual attorney’s fees, court costs, and all costs relating to execution in addition to the delinquent trash and water charges.
