Ordinance 2: Burning

Be it ordained by the Council of the Town of Townsend, State of Delaware, In Council Met:

SECTION I:

It shall be unlawful for any person, corporation, or other association to burn any combustible material, whether leaves, wood, or other debris, within the corporate limits of the Town of Townsend, except and unless such burning is supervised by the Townsend Fire Company and only after the prior approval of the Townsend Town Council.

SECTION II:

Any resident of the Town of Townsend, officer of the Townsend Fire Company, or member of the Council of the Town of Townsend shall have authority to order a person burning material in violation of this ordinance to cease and desist and upon that person’s failure to take immediate corrective action, he shall be deemed guilty of unlawful burning.

SECTION III:

Any person violating the provisions of this Ordinance shall be guilty of a violation and be punished by a fine of not less then ten dollars ($10.00) nor more than fifty dollars ($50.00).
